Built around the Texas Rules of Civil Procedure

Statewide service is only useful if the return holds up. Our work follows the Texas Rules of Civil Procedure.

  • TRCP 103 (who may serve). Citation may be served by a sheriff or constable, by a person authorized by law or court order, or by a process server certified under order of the Supreme Court of Texas. A party to the suit, or anyone with an interest in its outcome, may not serve.
  • TRCP 106 (methods). Service is made by personal delivery or by registered or certified mail, return receipt requested. If those attempts fail, Rule 106(b) lets the court authorize substituted service on a motion supported by a sworn statement describing the attempts, either by leaving the papers with someone over 16 at the defendant's location or by another method the court finds reasonably effective, including electronic means. We prepare Rule 106 motions and orders and offer eService when a court orders it.
  • TRCP 107 (return of service). The return must include the cause number, court, person served, date and time, address, and manner of service. A return from someone who is not a peace officer must be verified or signed under penalty of perjury. A default judgment can't be granted until the return has been on file for ten days, which is one reason we deliver affidavits within 48 hours.

When the address is bad

Addresses are often bad in statewide work: a defendant has moved, a business has closed, or a registered agent address is out of date. After two failed attempts, we run a complimentary skip trace using public records and USPS data to find alternate addresses before we contact you. For defendants who are deliberately avoiding service, we offer locate services and stakeouts. If a subject truly can't be found, we prepare, sign and notarize an affidavit of due diligence at no additional cost.
